Important Status & Tax Notice (Australia)

The God Guy is not a registered charity and is not endorsed as a Deductible Gift Recipient (DGR).
Any gifts, donations, or financial support made to The God Guy are not tax-deductible under Australian law. Payments for services and products are commercial transactions and, where applicable, GST may apply.

1. Acceptance of Terms

By visiting our website, booking our services, attending an event, or purchasing any product (digital or physical), you agree to these Terms & Conditions and our Privacy Policy.

​

2. Services We Provide

We offer faith-based speaking, preaching, workshops, retreats, staff professional development, prayer experiences, workplace talks, conference keynotes/workshops, and related services, plus digital/physical products (“Services”). We may update, modify, or discontinue Services at any time.

​

3. Bookings, Quotes & Payment
  • Booking confirmation. Dates are not secured until you receive written confirmation and we receive any required non-refundable deposit.

  • Fees & expenses. Quotes may exclude travel, accommodation, meals/per diem, ground transport, venue/AV hire, safeguarding requirements, and freight. These are billable to the client unless agreed otherwise in writing.

  • Payment terms. Invoices are due within 7 days (or as specified). Late balances may incur admin/interest charges.

  • Payment processors. We may use third-party processors (e.g., Stripe). You authorise the charges; third-party terms apply.

4. GST

Unless stated otherwise, all amounts are exclusive of GST. Where GST applies, you agree to pay the GST amount in addition to the fees.

​

5. Donations & Non-Deductibility

We are not a charity. Donations/support gifts are not tax-deductible and are generally non-refundable (except as required by law or at our discretion).

​

6. Cancellations, Changes & Force Majeure
  • Client cancellation.

    • ≥30 days prior: deposit retained; you remain liable for non-refundable expenses already incurred.

    • <30 days prior: up to 100% of fees may be payable, plus non-refundable expenses.

  • Our cancellation. If we cancel for illness, emergency, or force majeure (incl. severe weather, transport disruption, government orders), we’ll seek to reschedule. If reschedule is not possible, we’ll refund fees paid for the cancelled Service (excluding your third-party costs).

  • Force majeure. Neither party is liable for delay/failure due to events beyond reasonable control. Each party will use reasonable efforts to mitigate.

7. Client (Host) Responsibilities

You (the “Host”) are responsible for: safe, compliant venue; safeguarding/child-safety compliance; accessibility; adequate supervision (esp. for minors); AV/logistics; crowd management; insurance; and any required permits/approvals.

​

8. Pastoral, Not Professional Advice

Our content is faith-based and pastoral. We do not provide medical, psychological, legal, or financial advice. Services are not a substitute for professional care. Seek qualified advice where appropriate. In emergencies call 000.

​

9. Wellbeing & Sensitive Topics

Faith/life topics can be emotionally sensitive. Host should assess suitability and provide supports (e.g., school counsellors, EAP details, pastoral staff). We can adapt tone by agreement.

​

10. Intellectual Property (IP)

All talks, slides, frameworks, worksheets, recordings, branding, text, and graphics we create/deliver remain our IP. Unless we grant written permission, you may not record, livestream, publish, reproduce, or distribute our materials. We may grant a limited licence for internal use if separately agreed.

​

11. Digital Products & Downloads

Digital items are licensed (not sold) for personal/internal use only, non-transferable, not for public sharing or resale. Given their nature, digital purchases are non-refundable except as required by the Australian Consumer Law (ACL).

​

12. Merchandise & Shipping

We aim to dispatch promptly. Risk of loss passes on delivery to your address/carrier. Notify us within 7 days of issues. We may repair, replace, or refund as required by the ACL.

​

13. Acceptable Website Use

No scraping, hacking, malicious code, IP infringement, or harassment. We may restrict access for breach.

​

14. Limitation of Liability (ACL-Aware)

Nothing excludes or modifies non-excludable consumer guarantees under the ACL. To the extent permitted by law:

  • We exclude all implied warranties not mandated by the ACL;

  • Our liability for non-excludable guarantees is limited, at our option, to re-supply or refund;

  • We are not liable for indirect, consequential, special, or punitive losses (incl. lost profit, data, reputation, or business interruption);

  • Our total aggregate liability for any claim is capped at the amount you paid for the specific Service/product giving rise to the claim.

15. Indemnity

You (the Host/purchaser) indemnify and hold us harmless from claims, losses, costs, and liabilities arising from: (a) your breach of these Terms; (b) your venue/event safety, supervision, or compliance failures; (c) your misuse of our content; (d) your supplied materials/instructions that cause third-party infringement or defamation; (e) your promotion/advertising of the event.

16. Privacy

We handle personal information under our Privacy Policy and Australian privacy law. By booking or buying, you consent to that handling.

​

17. Event-Specific Terms (Rider)
17.1 Scope & Editorial Control
  • Editorial control. You book The God Guy for a faith-based message. We retain sole editorial control over delivery, tone, and content, and may adapt in the moment in response to pastoral needs, time constraints, or safety considerations.

  • Content boundaries. We’ll respect agreed sensitivities (e.g., language to avoid, timing limits). Provide these at least 7 days prior in writing. We may decline requests that materially alter our message or integrity.

  • No endorsement of Host views. Our participation does not imply endorsement of the Host’s broader beliefs, policies, or commercial activities.

17.2 Run-Sheet, Timing & Overtime
  • Run-sheet. Provide a final run-sheet 5 business days prior.

  • Soundcheck. Minimum 30 minutes onsite prior to session for audio/visual checks.

  • Overtime. If programme changes cause actual delivery beyond the agreed session by >15 minutes, Host agrees to a reasonable overtime fee or shortened delivery at our discretion.

17.3 Technical & Logistics (minimum)
  • Audio. Quality PA, one wireless headset or lapel mic, plus spare handheld.

  • Visuals. Projector/LED screen with HDMI or presenter laptop at lectern; clicker preferred.

  • Lighting. Adequate stage/front light.

  • Green room. Clean, private prep area with water/tea.

  • Accessibility. Step-free access where possible; Host to advise limitations in advance.

  • Recording. No recording/livestream without signed permission (see §19).

17.4 Safeguarding & Supervision
  • We comply with QLD Working with Children/Vulnerable People requirements.

  • We do not conduct unsupervised one-on-one ministry with minors.

  • Host provides appropriate adult supervision consistent with policy and law.

​

17.5 Safety, Security & Harassment-Free Environment
  • Host is responsible for crowd safety, orderly admission/seating, and security.

  • We reserve the right to pause, modify, or terminate participation if we reasonably believe safety, dignity, or legal compliance is compromised (no refund where termination is due to Host default).

​

17.6 Promotions & Ticketing
  • You may use our name/image to promote the booked event within the campaign window, provided materials are accurate and not misleading. We may request corrections.

  • Host is responsible for ticketing, refunds to attendees, and compliance with venue regulations.

​

17.7 Merch & On-Site Sales (if applicable)
  • With Host consent, we may sell merchandise/resources at the event. Host will provide a table, reasonable volunteer support, and a secure area. Any venue commission must be disclosed in advance.

​

17.8 Travel & Accommodation (if applicable)
  • Host covers economy return flights (or mileage at ATO rate), 1 checked bag, hotel near venue (quiet room), local transfers, parking, and reasonable meals/per diem.

  • Changes to travel requested by Host after booking that incur extra cost are payable by Host.

​

18. Content, Expression & Reliance
18.1 Nature of Content
  • Content is faith-based, pastoral, and opinion/experience-driven. It may reference Scripture, theology, and personal stories. It is not professional advice (see §8).

​

18.2 Accuracy & Theological Diversity
  • We take care to be accurate and respectful of Catholic teaching and ecumenical contexts; however, views expressed are our own at the time of delivery. Reasonable theological differences exist; no warranty is given that content aligns with every audience member’s tradition.

​

18.3 No Guarantee of Outcomes
  • Testimonies are illustrative and not guarantees of any outcome (e.g., healing, emotional relief, behaviour change, business or academic results).

​

18.4 Host-Supplied Materials
  • Where the Host supplies scripts, slides, questions, or themes, Host warrants they do not infringe third-party rights or defame any person, and indemnifies us for claims arising from Host-supplied material (see §15).

​

18.5 Sensitive/Triggering Content
  • We may reference topics such as identity, shame, grief, mental health, and relationships. Host agrees to provide visible support options (e.g., school counsellor/EAP/pastoral team) and crisis contacts. Participants may choose to opt-out or leave quietly at any time.

​

18.6 Religious Expression & Freedom
  • You acknowledge that our role involves religious expression protected by law. We may decline to speak on topics or adopt language that conflicts with our conscience, safeguarding duties, or the law. We will, however, remain respectful and pastoral in tone.

​

19. Recording, Media & Photography
19.1 By the Host
  • Prohibited without consent. Audio/video recording, livestreaming, or distribution is not permitted without our prior written consent and a signed licence specifying scope, platform(s), duration, territory, and attribution. Additional fees may apply.

  • Editing. Any permitted recording must not misrepresent our words or context. Final edits must be provided to us upon request.

19.2 By Us
  • We may capture reasonable behind-the-scenes or stage photos/video for ministry promotion, subject to venue/school policies. Host must notify us in writing before the event if filming/photography is restricted. We will honour any explicit non-consent requests.

​

19.3 Audience Privacy
  • Host is responsible for notifying attendees of any filming/photography and for obtaining any required consents, especially for minors. We will avoid close-ups of identifiable minors without Host-confirmed consent.

​

20. Public Statements & Defamation
  • We will not knowingly make defamatory statements. If an attendee or Host alleges defamation, you agree to notify us promptly and allow reasonable opportunity to respond/correct.

  • Host remains responsible for MC/panel prompts or materials they supply that could give rise to defamation or rights violations.

​

21. Health & Infectious Disease
  • We will follow reasonable venue health/safety protocols notified in advance. If a communicable disease risk materially affects the event, the parties will work in good faith to modify or reschedule.

​

22. Changes to Services or Terms

We may update Services and these Terms at any time. Updates apply from publication on our website. Continued use/booking constitutes acceptance.

​

23. Governing Law & Disputes

These Terms are governed by the laws of Queensland, Australia. The parties submit to the exclusive jurisdiction of QLD courts. Before proceedings, both parties will attempt good-faith resolution via discussion/mediation.

​

24. Severability

If any provision is unlawful or unenforceable, it will be severed and the remainder continues in full force.

​

25. Entire Agreement

These Terms, together with any signed proposal/booking form, event rider, licence(s), and our Privacy Policy, form the entire agreement and supersede prior discussions.
